The U.S. Department of Labor (the DOL) issued its final “persuader rule” on March 23, 2016, which was set to go into effect on April 25, 2016. The rule sought to significantly expand the scope of what employers and “persuaders” (i.e., consultants and outside counsel) must publicly report to the DOL about efforts to “persuade” employees about unionization.
