Disability Retaliation and Interference Claims

The ADA prohibits discrimination against an individual because he/she opposed a practice that the ADA prohibits or because he/she made a charge, testified, assisted, or participated in an investigation, proceeding, or hearing under the ADA.1 The ADA further prohibits employers from interfering with the exercise of protected ADA rights. FEHA also protects individuals from discrimination and/or retaliation for asserting protected disability rights.2
