Termination for Violation of Attendance Policy, Not Disability

A U.S. District Court in California ruled in favor of an employer who terminated an employee with a disability following the employee’s excessive absences. Dismissing the employee’s claim of disability discrimination, the court found that the employer demonstrated that it terminated the employee for a legitimate, nondiscriminatory reason: failing to notify his supervisor of an absence in a timely fashion in violation of company policy (Alejandro v. STMicroelectronics, 178 F.Supp.3d 850 (N.D. CA 2016)).​
