Under California’s Fair Employment and Housing Act (FEHA), employees can sue their employers and supervisors for disability harassment (Gov. Code sec. 12940(j)(1)), but the employee must show that the harassment was either severe or pervasive.
Such was the case in a recent disability harassment lawsuit, in which a California appellate court upheld a $500,000 jury award to an employee whose supervisor and coworkers mimicked his stutter (Caldera v. Department of Corrections and Rehabilitation, 25 Cal.App.5th 31 (2018)).
