NLRA Power: Remedies, Not Penalties

The NLRA is not a criminal statute. It is intended to prevent and remedy unfair labor practices, not to punish the person responsible for them. The Board is authorized not only to issue a cease-and-desist order, but “to take such affirmative action including reinstatement of employees with or without back pay, as will effectuate the policies of [the] Act.”
