General Guidelines for Responding to Reference Checks


A communication indicating if you would rehire a current or former employee is protected under California law. The law specifically provides protection from claims of libel or slander when you respond to an inquiry as to whether you would or would not rehire a current or former employee.1 In all cases, to avoid liability, make sure to communicate in a non-malicious way and only provide credible information.
