California Constitution

The California Constitution, Article I, section 31, provides that California state government shall not discriminate against or grant preferential treatment to any individual or group on the basis of race, sex, color, ethnicity or national origin in public employment, public education or public contracting. The prohibition covers:

  • California state government
  • Any city, county or city and county
  • Any public university system, including the University of California, community college districts, school districts or special districts
  • Any other political subdivision or governmental instrumentality of or within California
