Affirmative Action and State Contractors and Subcontractors

Despite Proposition 209, if you contract with California state government for public works, goods or services in any amount, you must prepare a nondiscrimination program. A nondiscrimination program can include an affirmative action component. You must include an analysis of your workforce by job, race and sex, as well as an outline of your equal employment efforts in the program.1 The state nondiscrimination program differs from the federal affirmative action plan in that you need not include hiring goals or timetables.
